Banking and insurance disputes turn on long contracts and detailed regulation. Al-Amthal advises banks, insurers and takaful companies on contracts and compliance, and represents institutions and their customers in claims and disputes, most of them before Egypt's Economic Courts, where our founder is admitted.
When you need a banking lawyer in Egypt
Banks need advice on facility agreements, guarantees, security over property and shares, and recovery when a borrower defaults. Borrowers and guarantors need advice when a bank calls in a loan, enforces its security or adds charges they dispute. Insurers and policyholders need help when a claim is refused or delayed.
Disputes under the banking laws are generally heard by the Economic Courts, established by Law No. 120 of 2008. Counsellor Sayed Mahmoud Farghaly is admitted before all Economic Courts and before the Court of Cassation.
How we handle banking and insurance matters
We read the full contract file: the facility agreement or policy, the general terms, the correspondence and the statements of account. Many disputes turn on a single clause or a missed notice. We then advise on the strongest position, and on whether negotiation, an accounting expert's review or a court case is the better path. Meetings are by appointment at our Nasr City office.
Insurance work covers property, motor, life and commercial policies, as well as takaful products structured on Islamic principles. For insurers and takaful companies we also review policy wordings and internal procedures against the rules of the Financial Regulatory Authority. We act for institutions and for individual customers, never for both sides of the same matter.
Banking and insurance questions across the Gulf
Since 1998 the firm has given legal consultations and written studies to clients in Kuwait, Bahrain, Saudi Arabia, the UAE, Lebanon and Morocco, including on banking, insurance and takaful questions. Through our offices in Kuwait and Dubai we advise Gulf institutions with business in Egypt, and Gulf-based Egyptians with loans, guarantees or policies in Egypt. Studies can be prepared in Arabic, English or German. We read both the Arabic and the English versions of a contract and point out where they differ, since the version that prevails can decide a dispute.

Questions clients ask
Where are banking disputes heard in Egypt?
Most disputes arising under the banking laws are heard by the Economic Courts, which were created to decide economic cases before specialised judges. Some disputes go to arbitration if the contract provides for it. We review your contract to confirm the right forum before any step is taken, because filing in the wrong place costs time.
What can I do if my insurance claim is refused in Egypt?
Ask the insurer for the refusal in writing, with its reasons. Then compare those reasons with the policy wording, the exclusions and the notices you gave. Many refusals turn on timing or on how a clause is read. We review the file, send a formal response and, if needed, take the claim to court or to the Financial Regulatory Authority.
Do you advise takaful companies?
Yes. We advise takaful operators and conventional insurers on contracts, product documents and compliance with Egyptian insurance regulation, and we prepare legal studies on takaful questions for clients in the Gulf. Our advice is written in Arabic, English or German, as the client prefers.
